Full Contest Rules
Purina® Paws for the Planet Contest (the “Contest”) is being conducted in Canada only and is subject to and governed by these rules (the “Contest Rules”) and applicable Canadian law. This Contest is void where prohibited by law. Entry in this Contest constitutes acceptance of the “Contest Rules”.
The Contest is sponsored by Nestlé Purina PetCare Canada. (the “Sponsor”).
The Contest opens at 12:00:00 AM (Mississauga time) on May 31, 2013 and closes at 11:59:59 PM (Mississauga time) on September 7, 2013 (the “Contest Period”).
The Contest is open to legal residents of Canada who have reached the age of majority in the province/territory in which they ordinarily reside, and who have a valid email address. Employees of the Sponsor, its advertising and promotional agencies, and who are domiciled with such employees or who are immediate family members of such employees, are not eligible to participate in the Contest. For the purpose of the Contest Rules, a person is an “immediate family” member” of another if that person is the spouse, parent, sibling, or child of the other.
How to enter:
To enter the Purina® Paws for the Planet Contest, follow the instructions below:
- Go to www.PawsforthePlanet.ca during the Contest Period.
- Enter your name, e-mail address, postal code and password in the applicable fields to create an account, and to enter the Contest. This includes confirmation that you have agreed to and shall be bound by the Contest Rules.
- Additional contest entries will be provided if you choose to answer a simple multiple choice question.
- You can return to the contest site, sign in to your account and answer another multiple choice question for additional bonus entries daily.
- Print your full name, complete address including postal code, daytime telephone number including area code, and and email address on a plain sheet of paper, and mail to: Purina® Paws for the Planet Contest, 171 East Liberty Street, Suite 270, Toronto, ON M6K 3P6. To be eligible, all mail-in entries must be post-marked during the Contest Period and received by the Contest closing date, September 7, 2013.
- There will be three (3) prizes (each, a “Prize”, and collectively the “Prizes”) awarded. Each prize will consist of Evergreen consulting on an enhanced, eco-friendly outdoor space and implementing the design, if possible . If Evergreen is unable to implement the design, a local landscape organization will implement Evergreen’s design for the prize winner . The backyard makeover will enhance the pet’s outdoor space in way that also makes it more environmentally friendly. The maximum cost to be incurred by the Sponsor in arranging for the design and implementation of the outdoor space is $5,000.The approximate value of each Prize is $5,000.
- Each Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsor. The Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if any Prize cannot be awarded for any reason.
Contest Draw and Winner Selection:
A random draw will be held on September 23, 2013 at 2:00PM (Mississauga time) to select three entrants who will be eligible to win the Prizes. The draw will take place at the offices of the independent agency in charge of managing the contest in Toronto, Ontario.
HOW TO CLAIM YOUR PRIZE:
The Sponsor will attempt to contact each selected entrant by phone and/or e-mail within 2 days of the draw. If the Sponsor is unable to contact a selected entrants after 3 attempts, that selected entrant shall lose the right to be awarded the Prize and the Sponsor may, in its discretion, select another entrant to be awarded the Prize.
The awarding of a Prize will be conditional upon the selected entrant correctly answering a skill testing question, without assistance of any kind. Each selected entrant may be required to furnish proof of identification. The Sponsor shall not be responsible for any delay in the awarding or delivery of any Prize for any reason outside of its control. A Prize will only be delivered to a verified winner. If a selected entrant is found to be ineligible, declines to accept the Prize, or in the event that a Prize confirmation is returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner at the Sponsor's sole discretion.
Each winner of a Prize will be required to execute a release (the “Release”) that confirms the Prize winner’s: (i) eligibility to enter the Contest and compliance with the Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of the Sponsor, its employees, directors, officers, suppliers, agents, sponsors and administrators, and all their affiliated and associated entities and advertising and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of the Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from; and (iv) grant to Sponsor of the unrestricted right, in the Sponsor’s sole discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use in all media now known or hereafter devised, in connection with the Contest the winner’s name, photograph, likeness, voice and biography, in the promotion of the Contest and exploitation thereof. The executed Release must be returned to the Sponsor within 10 business days of notification or the selected entrant will be disqualified and the Prize forfeited. Upon entering this Contest, all participants release the Releasees and all their respective employees from any potential liability related to the Prizes and the use and/or misuse of the Prizes
By participating in this Contest, each entrant agrees to abide and be bound by the Contest Rules and the decisions of the Sponsor, which decisions shall be final and binding in all respects.
Sponsor reserves the right at its sole discretion to disqualify any individual from the Contest, and to ban that individual from participation in any future promotion of the Sponsor, if the Sponsor finds or believes such individual (i) is tampering with or damaging, or attempting to tamper with or damage, the entry process or the operation of the Contest or the Contest website; (ii) is using any automated or robotic equipment to generate and/or submit entries into the Contest, (iii) is acting in violation of the Contest Rules or in an unsportsmanlike or disruptive manner, or (iv) is annoying, abusing, threatening or harassing the Sponsor, the Sponsor's agencies, other entrants or any other person (collectively, the “Prohibited Acts”).
THE SPONSOR RESERVES TO SEEK DAMAGES OR ANY OTHER LEGAL REMEDY AVAILABLE TO IT FROM ANY PERSON COMMITTING A PROHIBITED ACT. THE COMMISSION OF A PROHIBITED ACT MAY CONSTITUTE A VIOLATION OF CRIMINAL LAWS.
Limitation of Liability:
The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsor does not assume responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, the entries. The Sponsor is not sw responsible for any problems, failures or technical malfunction of any telephone network or lines, on account of technical problems or otherwise.
Each entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsor does not assume responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest.
Use of Personal Information:
All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, and representations are owned by or licensed to Nestlé Purina PetCare Canada and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
General Terms and Conditions:
The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. The Sponsor reserves the right to terminate, suspend and/or modify the Contest and /or the Contest Rules at its sole discretion. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
Termination of Contest/Amendment of Contest Rules:
If, for any reason, the online portion of the contest is not capable of being completed as planned including, but not limited to computer virus, bugs, tampering, technical failures or other causes beyond the control of the Sponsor, the Sponsor reserves the right, in its sole discretion, subject to the approval of the Régie in Quebec, to cancel, modify or suspend this Contest or the online portion of the Contest.
For Residents of Québec:
Any litigation respecting the conduct or organization of the Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. In the event that there is a discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, the English version shall prevail, govern and control.
